NAVOLA – TERMS OF SERVICE

Welcome to navola ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, as well as the purchase of any apparel or accessories from our store. By accessing our site or purchasing a product, you agree to be bound by these Terms and our Privacy Policy.

1. General Provisions & Eligibility

By placing an order, you represent that you are of legal age in your jurisdiction to enter into a binding contract.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion for any violation of these Terms or suspected fraudulent activity.

2. Account Security & User Responsibility

If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials.
navola is not liable for any loss or damage arising from unauthorized access to your account resulting from failure to safeguard your password.

3. Apparel Specifications, Sizing & Care

Color Accuracy: We strive to display product colors and images as accurately as possible. However, actual colors may vary slightly depending on display monitor settings.
Sizing & Fits: Size guides are provided for reference only. Minor variances in measurements (within standard industry tolerances) may occur across production batches.
Garment Care: navola is not responsible for damages, discoloration, or shrinkage resulting from improper washing, drying, or failure to follow care instructions printed on product labels.

4. Pricing, Payments & Order Acceptance

Pricing: All prices are displayed in the selected currency on our website and exclude shipping fees, taxes, or duties unless explicitly stated otherwise.
Payments: Purchases must be processed via our approved payment providers (e.g., Credit Card, PayPal, Apple Pay). You represent that all billing information provided is accurate and authorized.
Order Confirmation: An automated order confirmation does not constitute our final acceptance of an order. We reserve the right to limit quantities or cancel orders due to stock errors, pricing mistakes, or fraud risk.

5. International Shipping, Customs & Force Majeure

Worldwide Shipping: Delivery estimates provided at checkout are non-binding. We are not responsible for delivery delays caused by shipping carriers or international customs procedures.
Duties & Taxes: The customer is solely responsible for paying all applicable import duties, tariffs, VAT, sales taxes, or clearance fees required by their local destination country.
Force Majeure: navola shall not be held liable for failure or delay in performance caused by circumstances beyond reasonable control, including natural disasters, acts of war, strikes, global supply chain disruptions, or government restrictions.

6. Returns, Refunds & EU Right of Withdrawal

Standard Returns: Items in unworn, unwashed, and original condition with all tags intact may be returned within 14 days of delivery. Unless the item received is defective, return shipping costs are the sole responsibility of the customer.
European Union (EU) Right of Withdrawal: Customers residing within the EU have a statutory right to cancel and return their order within 14 days of receipt without providing a reason.
Non-Returnable Items: Final sale items, customized/personalized garments, and intimate apparel are non-refundable unless verified as damaged or defective upon delivery.

7. Intellectual Property Rights

All brand names, logos, clothing designs, domain names, photographs, graphics, and textual content associated with navola are the exclusive property of navola and protected under international copyright and trademark laws.
Unauthorized reproduction, copying, distribution, or commercial exploitation of any site content is strictly prohibited.

8. Limitation of Liability & Warranties

To the maximum extent permitted by applicable law, navola provides its store and products on an "as is" and "as available" basis. navola excludes all warranties, express or implied, and shall not be liable for any indirect, incidental, consequential, or punitive damages arising from product use or site navigation.

9. Severability

If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall remain enforceable to the fullest extent permitted, and the remaining provisions shall remain in full force and effect.

10. Governing Law & Jurisdiction

These Terms of Service and any separate agreements regarding product purchases shall be governed by and construed in accordance with the laws of Israel. Any legal action or dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Israel.
